If you need a breeding bird check, there are probably a few questions you have. The Wildlife and Countryside Act 1981 (as amended), makes it an offence to intentionally harm or take any wild bird, damage or destroy its nest whilst in use or being built, or take or destroy its eggs. There are also other birds listed under Schedule 1 which have additional protections in place.
If breeding birds are found on your development, there a number of measures which can be taken in order to protect the birds including:
- moving the development away from any breeding birds
- avoiding doing works during the breeding season (March to August)
- protecting and maintaining important habitats
- removing parts of a habitat when they are not in use by birds
- providing bird boxes and ledges in order to provide alternative nesting sites to breeding birds
- Creating a new habitat for breeding birds.
Sometimes, a licence is required in order to allow works to proceed legally if, for example harm cannot be avoided to Schedule 1 birds.
It is important to use the services of an experienced and qualified surveyor when carrying out a breeding bird survey. Breaking the law can lead to fines of up to £5000 per offence and prison sentences of up to six months are possible.
